Terms and Conditions for the Sale of Items

This Terms of Sale Agreement constitutes the agreement under which users of the Buyr.com service (“Service”) that are buying an item(s) (each, a “Buyer”) and users who are selling an item(s) (each, a “Seller”) who have entered into a transaction to purchase and sell certain items. The Buyer’s obligation to buy an item from Seller, and the Seller’s obligation to sell such item to Buyer, is expressly made conditional on each party’s agreement to these terms and conditions.

Items Provided and Prices

The items sold by Seller are new unless otherwise indicated on the Service, and Seller agrees that it has sufficient inventory to fulfill Buyer’s order.  Buyer shall pay the price set that Buyer committed to for the purchase of the Seller’s item(s). Seller agrees to sell to Buyer the item(s) at the Retail Price Seller agreed to sell such item(s) for on the Services.

Shipment

Seller will use commercially reasonable efforts to meet any shipment schedules set forth on the Services.  However, any shipment date or forecast provided by Seller is only an estimate of the time required to make shipment. Unless otherwise agreed to by Seller, all items will be shipped by Seller in the Seller’s standard packaging using a delivery service.

Returned Items

The Buyer may return, and Seller agrees to accept, any item purchased through the Services that is defective, damaged, faulty, incomplete, refurbished, used or broken, or which the Buyer is otherwise dissatisfied within thirty (30) days of the date of purchase by contacting Buyr at: support@buyr.com, or via live chat on Buyr.com.  Upon receipt of a return merchandise authorization (RMA) number, the Buyer must return the applicable item(s) to the Seller at the address provided by Buyr along with the RMA number. The Buyer will receive a refund of the purchase price following Seller’s receipt of the appropriate returned item(s) and RMA number.  

Warranty Pass Through

The Seller agrees to pass through to Buyer all manufacturer’s warranties, if any, related to the item(s) sold to Buyer.
